Terms of Service

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you don’t agree, please don’t use the Service.

SwishWork is a communication platform that helps people who need work done connect and talk with the professionals who do it. You can start a project, message a pro, share photos and documents, and exchange quotes — on the web or in the app. SwishWork is the venue for these conversations; we are not a party to any agreement, quote, or work arranged between a homeowner and a pro, and we don’t perform the work ourselves.

• You must be at least 18 years old to use the Service.
• You’re responsible for the accuracy of the information you provide and for keeping your account credentials secure.
• You’re responsible for activity that happens under your account. Tell us right away if you suspect unauthorized use.
• You may sign in with email or with Google, Facebook, or Apple. You may close your account at any time — see our data deletion page.

When using the Service, you agree not to:

• Break the law, infringe others’ rights, or post content that is unlawful, harassing, deceptive, or harmful.
• Impersonate anyone, misrepresent your identity, or send spam or unsolicited promotions.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems, or interfere with how the Service works.
• Scrape, harvest, or collect data from the Service except as we expressly permit.
• Use the Service to send messages to people who have not agreed to hear from you.

We may suspend or terminate accounts that violate these Terms or put our users or platform at risk.

You keep ownership of the content you submit — your messages, project details, photos, and documents. You grant SwishWork a limited license to host, store, display, and transmit that content as needed to operate the Service for you (for example, delivering a message and its attachments to the pro you chose). You’re responsible for the content you share and for having the rights to share it. SwishWork and its name, design, and software remain our property.

The Service delivers messages and notifications about your projects and conversations by email and, if you opt in, by SMS text message. By providing your mobile number and opting in, you consent to receive SMS text messages from SwishWork related to your projects and conversations. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for help.

How we handle your mobile number and SMS consent — and our promise never to share that consent with third parties for their marketing — is described in our Privacy Policy.

We rely on trusted providers to run the Service — including Supabase (hosting and database), Stripe (payments), Resend (email), Twilio (SMS), and Vercel (hosting). The Service may also link to or interact with third-party sites and tools. We don’t control those third parties and aren’t responsible for their content or practices; your use of them is governed by their own terms.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or secure, and we don’t guarantee the conduct, quality, or outcome of any homeowner or pro you connect with through the Service.

To the fullest extent permitted by law, SwishWork and its directors, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or CAD $100.

You agree to indemnify and hold harmless SwishWork from any claims, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or the rights of others.

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Manitoba, Canada for any dispute that isn’t resolved informally.

We may update these Terms as the Service evolves. When we do, we’ll revise the “last updated” date above. Material changes will be communicated through the Service, and your continued use after a change means you accept the updated Terms.
